(Personal Data Processing Policy)
This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information that the Website "Vavilon Service", located at the address - https://vavilon.od.ua, may obtain about the User while using the website, programs and products.
This personal data processing policy has been compiled in accordance with the requirements of the Law of Ukraine "On Personal Data Protection" dated June 1, 2010 No. 2297-VI and defines the procedure for processing personal data and measures to ensure the security of personal data taken by the Administration of the Babylon Service website.
The administration of the Babylon Service website sets as its most important goal and condition for carrying out its activities the observance of the rights and freedoms of man and citizen when processing their personal data, including the protection of the rights to privacy, personal and family secrets.
1. Definition of terms
1.1 The following terms are used in this Privacy Policy:
1.1.2. "Site "Vavilon Service" (hereinafter referred to as the Site) is a set of graphic and information materials, as well as computer programs and databases that ensure their availability in the information and telecommunications network Internet, identified by the domain name https://vavilon.od.ua and its subdomains. The Site contains information about Goods and (or) Services and (or) Other values for the User, Seller and/or Service Provider, which allows you to make a choice, order and (or) purchase a Product, and/or receive a service.
1.1.2. "Administration of the site "Babylon Service" (hereinafter referred to as the Site Administration)" - authorized employees for site management, acting on behalf of the Site, who organize and process personal data, and also determine the purposes of personal data processing, the composition of personal data subject to processing, actions or operations performed with personal data.
1.1.4. "Personal data" - any information relating to a directly or indirectly identified or identifiable natural person (personal data subject).
1.1.5. "Confidentiality of personal data" - a requirement that must be observed by the Site Administrator or another person who has gained access to personal data, not to allow their dissemination without the consent of the personal data subject or the presence of another legal basis.
1.1.6. "Personal data information system" - a set of personal data contained in databases and provided with information technologies and technical means for their processing.
1.1.7. "Processing of personal data" - any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.1.8. "Automated processing of personal data" - processing of personal data using computer technology.
1.1.9. "Blocking of personal data" - temporary cessation of processing of personal data (except in cases where processing is necessary to clarify personal data).
1.1.10. "Depersonalization of personal data" - actions in which it is impossible to determine without using additional information whether personal data belongs to a specific User or other personal data subject.
1.1.11. "Provision of personal data" - actions designed to disclose personal data to a specific person or a specific group of persons.
1.1.12. "Dissemination of personal data" - any actions aimed at disclosing personal data to an unspecified number of persons (transfer of personal data) or at familiarizing an unlimited number of persons with personal data, including publishing personal data in the media, posting on information and telecommunications networks or providing access to personal data in any other way.
1.1.13. "Cross-border transfer of personal data" - the transfer of personal data to the territory of a foreign state to a government body of a foreign state, a foreign individual or a foreign legal entity.
1.1.14. "Destruction of personal data" - any actions as a result of which personal data are irretrievably destroyed with the impossibility of further restoration of the content of personal data in the personal data information system and (or) the material carriers of personal data are destroyed.
1.1.15. "User" - a person who has access to the Site via the Internet and uses the Site.
1.1.16. "Cookies" are a small piece of data sent by a web server and stored on the user's computer, which a web client or web browser sends to the web server in an HTTP request each time it tries to open a page of the corresponding site.
1.1.17. IP address — a unique network address of a node in a computer network built using the IP protocol.
2. General provisions
2.1. The User's use of the Site constitutes agreement with this Privacy Policy and the Terms of Processing of the User's Personal Data.
2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the Site.
2.3. This Privacy Policy applies only to the Babylon Service Site. The Site does not control and is not responsible for third-party sites to which the User may access through links available on the Site. Such sites may collect or request other personal information from the User, and may also perform other actions.
2.4. The site administration does not verify the accuracy of personal data provided by the site User.
3. Subject of the privacy policy
3.1. This Privacy Policy establishes the obligations of the Site Administration to non-disclosure and ensure the confidentiality of personal data that the User provides at the request of the Site Administration when registering on the site or when placing an order for the purchase of the Product.
3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out the registration form or feedback form on the Site and includes the following information:
3.2.1. Surname, first name, patronymic of the User;
3.2.2. User's contact phone number;
3.2.3. Email address (e-mail);
3.2.4. Delivery address of the goods;
3.2.5. Place of residence of the User.
3.3. The Site protects Data that is automatically transmitted during the process of viewing advertising blocks and visiting pages:
IP address;
information about cookies;
information about the browser (or other program that provides access to advertising);
access time;
the address of the page where the advertising unit is located;
referrer (address of the previous page).
3.3.1. Disabling cookies may result in inability to access parts of the Site that require authorization.
3.3.2. The site collects statistics about the IP addresses of its visitors. This information is used to identify and resolve technical problems, to monitor the legality of financial payments made.
3.4. The Site also collects and processes anonymized data about visitors (including cookies) using Internet statistics services (Google Analytics and others).
3.5. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is subject to reliable storage and non-distribution, except for the cases provided for in clauses 5.2. and 5.3. of this Privacy Policy.
4. Purposes of collecting user personal information
4.1. The User's personal data may be used by the Site Administration for the purpose of:
4.1.1. Identification of the User registered on the Site for placing an order and (or) concluding a Contract for the purchase and sale of goods remotely with the Site.
4.1.2. Providing the User with access to personalized resources of the Site.
4.1.3. Establishing feedback with the User, including sending messages, requests regarding the use of the Site, providing services, processing requests and applications from the User.
4.1.4. Determining the User's location to ensure security and prevent fraud.
4.1.5. Confirmation of the accuracy and completeness of personal data provided by the User.
4.1.6. Creating an account to make purchases, if the User has agreed to create an account.
4.1.7. Notification of the Site User about the status of the Order.
4.1.8. Processing and receiving payments, confirmation of tax or tax benefits by the User.
4.1.9. Providing the User with effective customer and technical support in the event of problems related to the use of the Site.
4.1.10. Providing the User, with his consent, with product updates, special offers, price information, newsletters and other information on behalf of the Site or on behalf of partners.
4.1.11. Carrying out advertising activities with the consent of the User.
4.1.12. Providing the User with access to the sites or services of the Site's partners in order to obtain products, updates and services.
4.2. Depersonalized data of Users collected using Internet statistics services is used to collect information about Users' actions on the Site, to improve the quality of the Site and its content.
5. Methods and terms of processing personal information
5.1. The processing of the User's personal data is carried out without any time limit by any lawful means, including in personal data information systems using automation tools or without the use of such tools.
5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular to courier services, postal organizations, telecommunications operators solely for the purpose of fulfilling the User's order placed on the Site, including the delivery of the Goods.
5.3. The User's personal data may be transferred to authorized state authorities of Ukraine only on the grounds and in accordance with the procedure established by the legislation of Ukraine.
5.4. In the event of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data.
5.5. The site administration takes the necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties.
5.6. The site administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
5.7. If inaccuracies are found in personal data, the User can update them independently by sending a message to the Site Administration using the feedback form in the section "«CONTACTS» marked "Update personal data".
5.8. The term of processing personal data is unlimited. The user may withdraw his consent to the processing of personal data at any time by sending a message to the Site Administration via the feedback form in the section "«CONTACTS» marked "Withdrawal of consent to the processing of personal data.".
5.9. Legal basis for processing personal data
5.9.1. The Site Administration processes the User's personal data only if they are filled in and/or sent by the User independently through special forms posted on the Site. By filling in the relevant forms and/or sending their personal data to the Site Administration, the User expresses their consent to this Policy.
5.9.2. The Operator processes depersonalized data about the User if this is permitted in the User's browser settings (including saving cookies and using JavaScript technology).
6. Obligations of the parties
6.1. The User is obliged to:
6.1.1. Provide information about personal data necessary for using the Site.
6.1.2. Update and supplement the provided information about personal data in the event of changes to this information.
6.2. The site administration is obliged to:
6.2.1. Use the information received exclusively for the purposes specified in clause 4 of this Privacy Policy.
6.2.2. Ensure that confidential information is kept secret, not disclosed without the prior written permission of the User, and not sold, exchanged, published or disclosed in other possible ways the User's personal data transmitted, except for clauses 5.2. and 5.3. of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect this type of information in existing business transactions.
6.2.4. Block personal data belonging to the relevant User from the moment of the request or request of the User or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification in case of detection of inaccurate personal data or illegal actions.
7. Responsibility of the parties
7.1. The site administration, which has failed to fulfill its obligations, is liable for losses incurred by the User in connection with the improper use of personal data in accordance with the legislation of Ukraine, except for the cases provided for in clauses 5.2., 5.3. and 7.2. of this Privacy Policy.
7.2. In the event of loss or disclosure of Confidential Information, the Site Administration is not liable if this confidential information:
7.2.1. Became public domain until its loss or disclosure.
7.2.2. Was received from a third party prior to its receipt by the Site Administration.
7.2.3. Was disclosed with the consent of the User.
8. Dispute Resolution
8.1. Before filing a lawsuit with a court regarding disputes arising from the relationship between the Site User and the Site Administration, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing of the results of the claim review.
8.3. If an agreement is not reached, the dispute will be referred for consideration to a judicial body in accordance with the current legislation of Ukraine.
8.4. The current legislation of Ukraine applies to this Privacy Policy and relations between the User and the Site Administration.
9. Additional Terms
9.1. The site administration has the right to make changes to this Privacy Policy without the consent of the User.
9.2. The new Privacy Policy comes into force from the moment of its posting on the Site, unless otherwise provided by the new version of the Privacy Policy.
9.3. All suggestions or questions regarding this Privacy Policy should be reported to the "CONTACTS" section.
9.4. The User may obtain any clarifications on issues of interest regarding the processing of his/her personal data by contacting the Site Administration using the feedback form in the "CONTACTS" section.
9.5. The current version of the Privacy Policy is posted on the page at https://vavilon.od.ua/ua/politika-konfidentsinosti.
